Town Bridge Communications reserves the right to suspend or cancel a customers access to any or all services provided by Town Bridge Communications when Town Bridge Communications decides that the account has been used inappropriately. |

| |
Town Bridge Communications. ("The Company") agrees to furnish services to the Subscriber, subject to the following TOS (Terms of Service). |

| |
Use of Service constitutes acceptance and agreement to Town Bridge Communications TOS (Terms of Service). |
|
| |
|
|
| |
All provisions of this contract are subject to the TOS (Terms of Service) of Town Bridge Communications. |
|
| |
|
|
| |
1) Disclosure To Law Enforcement |
|
| |
Town Bridge Communications may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies. We will cooperate fully with law enforcement agencies. In addition shall have the right to suspend/terminate all services set forth in this agreement. |
|
| |
|
|
| |
2) Service Rates And Price List Changes |
|
| |
The subscriber acknowledges that the nature of the service furnished and the initial rates and charges have been communicated to the subscriber. We reserve the right to change prices listed on Town Bridge Communications, and the right to increase/decrease the amount of resources given to plans at any time. |
|
| |
|
|
| |
3) Payment |
|
| |
Establishment of this services is dependent upon receipt by the company of payment of stated charges. Subsequent payments are due on the anniversary date of the month/year for that month/year's service. The subscriber agrees that the company automatically charges subscriber's paypal every month. If you desire to cancel your account, please follow the proper procedure to do this as outlined in this TOS. |

4) Suspension/Termination Of Service Or Account Cancellation |
|
| |
Town Bridge Communications reserves the right to suspend network access to any customer if in the judgment of the network administrators the customer's server is the source or target of the violation of any of the other terms of the TOS or for any other reason which Town Bridge Communications chooses. If inappropriate activity is detected, all accounts of the customer in question will be suspended until an investigation is complete. Prior notification to the customer is not assured. In extreme cases, law enforcement will be contacted regarding the activity. The customer will not be credited for the time the customer's machines were suspended. The company may suspend the service after 5 days of the due date upon the failure of subscriber to pay charges when due and after 15 days of the due date may be terminated and all files will be cancelled. All requests for cancelling accounts must be made via email to info@townbridgecom.com. |

5) Refund And Disputes |
|
| |
Once service has been established, payment will not be refunded for any reason. However, should there be a degradation in quality of service and/or severe outage, Town Bridge Communications reserves the right to offer the client a partial or full refund, and in extreme cases financial compensation in the form of credit on the clients account. |
|
| |
|
|
| |
6) Responsibility And Undesirable Content |
|
| |
You, as Town Bridge Communications customer, are solely responsible for the content stored on and served by your Town Bridge Communications account. Certain types of content are not permitted on our network. We do not host pornographic content of any description. We reserve the right to determine what constitutes pornographic content and what does not. Content relating to Hacking, Cracking, Warez, IRC. SHOUTcast and PicoStreamer are not allowed without our authorization. HYIP (High Yield Investment Programs), Ponzi schemes or pyramid schemes are not permitted on our network. Our web servers may not be used to provide proxy servers (or paid to click). Software downloads may only be hosted if you are the writer and copyright owner of the software, all other software including freeware, shareware and trial software is forbidden. The sale of resellable eBooks is ok. Large download files must can be only hosted on our download server solutions not in our web hosting shared solutions. We not allow files share website on our hosting plans.

7) Notification Of Violation |
|
| |
Town Bridge Communications is under no duty to look at each customer's or user's activities to determine if a violation of the TOS has occurred, nor do we assume any responsibility through our TOS to monitor or police Internet-related activities.
Users that determines to have committed a violation of any element of this TOS shall be subject to immediate suspension or termination of service without further notice. |

8) Liability |

The subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons. Therefore, the subscriber agrees that the company shall not be liable for any damages. In no event shall the company be liable for any special or consequential damages, loss or injury. |

| |
9) Backup And Data Loss |
|
| |
Your use of the service is at your sole risk. Town Bridge Communications is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Town Bridge Communications servers. |
|
| |
|
|
| |
10) Support Boundaries |
|
| |
Town Bridge Communications, provides support to our subscribers. Town Bridge Communications only ensures that the service is online and is remotely accessible, does not offer tech support for application specific issues such as cgi programming, html or any other such issue. Does not provide technical support for your customers. We encourage you to contact us on our web site. |

| |
11) Miscellaneous Provisions |
|
| |
You must provide us with, and keep current, good contact information for you. E-mail, and telephone contacts are used, in that order of preference.
a) A waiver by the company of any breach of any provision of this agreement by subscriber shall not operate as or be construed as a continuing or subsequent waiver thereof or as a waiver of any breach of any other provision thereof.
b) The subscriber shall not transfer or assign this agreement without the prior written consent of the company. Company may assign agreement at anytime without consent from or notice to the subscriber. Company reserves right to cancel customers rights under this contract at anytime without further obligation.
c) Town Bridge Communications disclaims any responsibility for any such inappropriate use and any liability to any person or party for any other person or party's violation of this policy.
d) Town Bridge Communications is not responsible for any damages your business may suffer. Town Bridge Communications does not make implied or written warranties for any of our services. Town Bridge Communications denies any warranty or merchantability for a specific purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Town Bridge Communications. |

12) SPAM And Unsolicited Commercial Email (UCE) |
|
| |
Takes a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM over our network. Very simply this means that customers of may not use or permit others to use our network to transact in UCE. Customers of may not host, or permit hosting of, sites or information that is advertised by UCE from other networks. Violations of this policy carry severe penalties, including termination of service. |

a) Violation of 's SPAM policy will result in severe penalties. Upon notification of an alleged violation of our SPAM policy, will initiate an immediate investigation (within 48 hours of notification). During the investigation, may restrict customer access to the network to prevent further violations. If a customer is found to be in violation of our SPAM policy, may, at its sole discretion, restrict, suspend or terminate customer's account. Further, reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation.
b) As our customers are ultimately responsible for the actions of their clients over the network, it is advisable that Customers develop a similar, or stricter, policy for their clients. |

IMPORTANT NOTICE:
"Anyone hosting websites or services on their server that support spammers or cause any of our IP space to be listed in any of the various spam databases will have their server immediately removed from our network. The service will not be reconnected until such time that you agree to remove any and all traces of the offending material immediately upon reconnection and agree to allow us access to the account to confirm that all material has been completely removed. Severe violations may result in immediate and permanent removal of the server from our network without notice to the customer. Any server guilty of a second violation will be immediately and permanently removed from our network without notice". |

13) Network |
|
| |
a) IP address ownership, if Town Bridge Communications assigns to customer an internet protocol address for customer's use, the right to use that internet protocol address shall belong only to Town Bridge Communications, and customer shall have no right to use that internet protocol address except as permitted by in its sole discretion in connection with the services, during the term of this agreement Town Bridge Communications shall maintain and control ownership of all internet protocol numbers and addresses that may be assigned to customer by Town Bridge Communications, and reserves the right to change or remove any and all such internet protocol numbers and addresses, in its sole and absolute discretion. Our allocation of IP addresses is limited by ARIN's new policies. These new policies state that use of IP addresses for IP based virtual hosts will not be accepted as justification for new IP addresses. What this means to you is that you must use name-based hosting where possible. We will periodically review IP address usage, and if we find that clients are using IP addresses where name-based hosting could be used, we will revoke authorization to use those IP addresses that could be used with name-based hosting.
b) Bandwidth usage, Town Bridge Communications will monitor customer's bandwidth usage. Town Bridge Communications shall have the right to take corrective action if customer's usage negatively impacts other clients.
c) System and network security, users are prohibited from violating or attempting to violate the security of the network. Violations of system or network security may result in civil or criminal liability we will investigate occurrences, which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. These violations include, without limitation:
1) Accessing data not intended for such user or logging into a server or account, which such user is not authorized to access.
2) Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization.
3) Attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, "flooding", "mail bombing" or "crashing".
4) Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.
5) Taking any action in order to obtain services to which such user is not entitled.

14) Reseller Client Responsibility |
|
| |
Resellers are responsible for supporting their clients. Town Bridge Communications does not provide support to our reseller's clients. If a reseller's client contacts us, we reserve the right to place the client account on hold until the reseller can assume their responsibility for their client. All support requests must be made by the reseller on their clients' behalf for security purposes. Resellers are also responsible for all content stored or transmitted under their reseller account and the actions of their clients'. Town Bridge Communications will hold any reseller responsible for any of their clients actions that violate the law or the TOS. |

15) Web Hosting Shared (Non-Reseller Accounts) |
|
| |
Shared accounts may not resell web hosting to other people, if you wish to resell hosting you must use a reseller account. Web hosting servers are not backed up. You must maintain your own backups. Files depository not allowed. |

| |
16) Dedicated Servers And VPS |
|
| |
Town Bridge Communications reserves the right to reset the password on a dedicated server and VPS if the password on file is not current so that we may do security audits as required by our datacenter. It is the responsibility of the client to ensure that there is a valid email address and current root password on file for their dedicated server and VPS on file to prevent downtime from forced password resets. Town Bridge Communications reserves the right to audit servers as needed and to perform administrative actions at the request of our datacenter. Dedicated servers and VPS are not backed up by us and it is the responsibility of the client to maintain backups or have a solution for this. You may purchase an additional hard drive and maintain backups to it as the most simple solution. It is your responsibility to maintain backups. Dedicated Server and VPS are self-managed. |

17) FTP Files Storage Hosting |
|
| |
If we see abuse action we may suspend/terminate your FTP Files Storage Hosting account. FTP Files Storage Hosting is not backep up by us and it is the responsibility of the client to maintain backups or have a solution for this. |

| |
18) Picostreamer Streaming |
|
| |
a) Broadcast Bitrate - Overstreaming
Utilizing a higher bitrate than shown on your account details. Picostreamer operate in a shared environment where bandwidth is provisioned very carefully, so abusing your bitrate will almost always result in server termination. It is your responsibility to maintain proper control over the broadcast bitrate. Picostreamer audio and video streams must be between 8kbps and the bitrate reflected on subscriber's account.
b) Content
Client agrees to take sole responsibility for all content, including audio and video streaming, web pages, and any other service that is utilized. Town Bridge Communications is not liable for any action taken against a client as a result of their stream content or web content.
c) Upgrade/Downgrade Policies
One server type/format change per month unlimited listeners upgrades per month 1 listener downgrade per month.
d) Licenses
Client is solely responsible for any applicable license fees for their location. Town Bridge Communications does not award free licensing to clients, such as ASCAP, BMI, SESAC, RIAA, SIAE, GEMA or CARP.

19) Disclaimer |

| |
Town Bridge Communications shall not be responsible for any damages your business may suffer. Town Bridge Communications makes no warranties of any kind, expressed or implied for services we provide. Town Bridge Communications disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Town Bridge Communications and its employees. |

20) Amendments |
|
| |
Town Bridge Communications reserves the right to revise, amend, or modify this TOS (Terms of Service) and our other policies and agreements at any time and in any manner. It is the responsibility of subscriber to periodically check this TOS for such changes. |
